PRIVACY NOTICE regarding personal data collected by LINKSSTER .COM (hereinafter referred to as “LINKSSTER “)
1.- General
Linksster is a company committed to and respectful of the rights over the personal data of individuals, recognized in article 16, paragraph ii of the Mexican Constitution, as well as the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals. Therefore, this privacy notice is made available to you, so that the owner of the personal data is empowered to exercise his right to informational self-determination.
1.2.- This privacy notice is made available to the owners on the website whose domain name is https://linksster.com, hereinafter referred to as the Linksster website.
1.3.- You (hereinafter referred to as the “holder” or the “holders”) by entering and using the Linksster website, declare that you understand and accept the terms and conditions contained in this notice and expressly declare and grant your acceptance and consent using electronic means for this purpose, in terms of the provisions of article 1803 of the federal civil code.
If the owner does not fully and completely accept the terms and conditions of this notice, he/she must refrain from providing any personal data to Linksster by any means, including the Linksster website.
1.5.- In the event that the owner accepts the same and/or provides Linksster with his/her personal data, such action will be considered as his/her absolute and express acceptance of the privacy notice published by Linksster on the aforementioned web page, at the very moment in which the owner provides his/her personal data and/or in which he/she has access to or is provided with this privacy notice.
1.6.- The parties agree that in the absence of error, fraud, malice, bad faith or any other defect of the will that could nullify the validity of this instrument, both agree to abide by the provisions of the following:
Definitions
Personal Data – Any information concerning an identified or identifiable natural person.
2.2.- Sensitive Personal Data – Those personal data that affect the most intimate sphere of the Data Controller, or whose improper use may give rise to discrimination or entail a serious risk to the Data Controller. In particular, are considered sensitive those that may reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions, sexual preference.
2.3.- Data Subject – The natural person to whom the personal data identifies or corresponds.
2.4.- Controller – Natural or legal person (LINKSSTER) of private nature that decides on the processing of personal data.
2.5.- Processor: The individual or legal entity that alone or jointly with others processes personal data on behalf of the controller.
2.6.- Processing – The collection, use (including access, handling, use, exploitation, transfer or disposal of personal data), disclosure or storage of personal data by any means.
2.6.1.- Transfer: Any communication of data to a person other than the data controller or data processor.
2.6.2.- Remission: The communication of personal data between the data controller and the data processor, within or outside Mexican territory.
2.7.- ARCO Rights – Rights of access, rectification, cancellation and opposition.
2.8.- Tacit Consent: It will be understood that the owner has consented to the processing of the data, when the Privacy Notice has been made available to him/her and he/she does not express his/her opposition.
2.9.- Primary Purposes – Those purposes for which personal data are primarily requested and which gives rise to the relationship between LINKSSTER and THE HOLDER.
2.10.- Secondary Purposes – Those purposes that are not essential to the relationship between LINKSSTER and the HOLDER, but with its treatment contributes to the fulfillment of the corporate purpose of LINKSSTER.
3.- Identity and address of the person responsible for collecting the personal data
3.1 .- The responsible for obtaining personal data is Linksster.com, (hereinafter LINKSSTER) who undertakes to respect the provisions of this Privacy Notice (hereinafter the “Notice”), which is made available in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law” or “LFPDPPP”, indistinctly) and is applicable with respect to personal data of individuals, LINKSSTER obtained in connection with the activities it performs with respect to users of THE LINKSSTER WEBSITE and social networks in which LINKSSTER participates.
3.2 .- The address for the purposes of this notice establishes LINKSSTER, is located at Avenida Universidad 1456 Colonia Narvarte delegation Benito Juarez, CP 03023, Mexico City, Mexico.
4.- Personal data collected
4.1 .- The HOLDER acknowledges and agrees that LINKSSTER will obtain directly or through agents, the following personal data, according to the relationship with the HOLDER:
Users of THE LINKSSTER WEBSITE and the social networks in which LINKSSTER participates: full name, date of birth, age, gender, e-mail, landline and/or cell phone number, credit and/or debit card data, health data, physical characteristics data, financial and/or property data, PayPal® account data, user name of the social networks in which LINKSSTER participates.
4.2 .- The HOLDER in this act, gives express consent in terms of Article 8 of the LFPDPPP, for LINKSSTER, treat your personal data, including financial and / or property contained in this clause, to fulfill the purposes set out in this Privacy Notice.
4.3 .- LINKSSTER states that it will not treat sensitive personal data of the HOLDER of any kind.
4.4 .- The HOLDER in this act, under oath, agrees that the data provided to LINKSSTER are true, current and correct. In addition, you agree to hold LINKSSTER harmless from any claim or claim arising from errors in the personal data you have provided.

LINKSSTER acknowledges that LINKSSTER WEBSITE may use cookies in connection with certain features or functions. Purposes of the processing of personal data
LINKSSTER accepts and acknowledges that it may treat directly or through agents, the personal data of the OWNER, in accordance with the type of relationship it has with it, for the following primary purposes:
a) HOLDER – User of the WEBSITE AND SOCIAL NETWORKS IN WHICH LINKSSTER PARTICIPATES:

Purchase of SEO texts
Purchase of any other SEO service offered within the site
To intermediate in the publication of backlinks, provide the necessary advice for the purchase of backlinks, purchase of SEO texts and other SEO services;
Address any complaints, questions or comments related to the request for quotation.
2. Contact you by email, social networks or any other means, to support the User to complete a purchase process through the LINKSSTER intermediation platform.
3. Make payments to third party providers of products and / or services offered through the LINKSSTER brokerage platform.
4. Contact you by any means in order to make clarifications and follow-up on payments or any other situation arising from the products and / or services offered through the LINKSSTER brokerage platform, as well as to address comments on them.
5. Generate a database record of LINKSSTER WEBSITE users, which will be retained for 5-five years from the time they are collected by LINKSSTER.
LINKSSTER may process the personal data of the HOLDER for the following secondary purposes:
To evaluate the quality of the services and/or products offered by the companies evaluated in LINKSSTER through its intermediation platform, as well as the quality of attention to their comments or requests from Users.
2. To provide you with additional communications and information such as newsletters, bulletins and invitations to events.
3.. To send you offers, discounts and/or promotions both from LINKSSTER and third party suppliers and/or business partners.
4. Inform via email, social networks or any other means about changes or new products and / or services that are related to the products and / or services offered by users through the LINKSSTER brokerage platform.
5. Generate internal reports on the use of THE LINKSSTER WEBSITE.
6. Massive mailings of mail marketing.

7.- Limitations on access to and disclosure of personal data
7.1.- LINKSSTER , undertakes to make its best effort to protect the security of personal data that the HOLDER is delivering, by entering into legal acts, the use of technologies and antivirus systems, which control access, use or unauthorized disclosure of personal information; for this purpose, personal information is stored in databases with limited access that are located in controlled facilities with security mechanisms; uses Comodo SSL security certificates, which ensures that the personal data of the OWNERS will not be public and prevents access to this personal data by third parties; LINKSSTER is committed to the information provided by the OWNER, is considered confidential and used under full privacy.
7.2 .- In this regard, LINKSSTER is obliged to take the necessary measures to ensure that those responsible for hiring comply with the purposes set out in this Privacy Notice.
7.3.- Additionally, you are informed that in order to avoid receiving advertising in general, you may register in the Public Registry to Avoid Advertising. For more information you can visit the website of the Federal Consumer Protection Agency (PROFECO) and additionally, another way in which you can limit the processing of your personal data is the Public Registry of Users that has the National Commission for the Defense of Users of Financial Services (CONDUSEF).
Notwithstanding the foregoing and in case of security breaches occurring at any stage of treatment, which significantly affect the economic or moral rights of the OWNERS, they will be informed by email, immediately, so that the latter can take appropriate measures to defend their rights, excluding any responsibility LINKSSTER, if the violation is not attributable to him.

Means to revoke consent
The OWNER of the personal data may revoke the consent given with the acceptance hereof. Such revocation of consent that is granted electronically, must be done by observing the following procedure, using the form that LINKSSTER makes available:
9.1.- To send an e-mail to the attention designated in point 8-eight of this Notice, by means of which such requests will be attended.
9.2.- Send a request or data message to the e-mail address specified above, indicating:
9.2.1. The full name of the OWNER, address and e-mail address to receive the response generated in response to your request.
9.2.2. The reason for your request.
9.2.3. The arguments supporting your request or petition.
9.2.4. Official document that accredits your identity and proves that you are who you say you are.
9.2.5. Date from which the revocation of your consent becomes effective.
LINKSSTER will notify in writing, via email, to the OWNER, within a maximum period of 20-twenty days from the date on which the request was received on the exercise of ARCO rights, the resolution adopted, in order that, if appropriate, it becomes effective within 15-fifteen days from the date on which the response is communicated, by a message containing that it has executed all acts aimed at not processing the personal data of the OWNER.
10.- Means to exercise ARCO rights
In the event that the HOLDER needs to Access, Rectify, Cancel or Oppose the personal data provided to LINKSSTER, the HOLDER must follow the following procedure, using the format that LINKSSTER makes available:
10.2.- Send an e-mail to the attention designated in point 8-eight of this Notice, by means of which such requests will be attended, indicating the following:
10.2.1.- The full name of the OWNER, address and e-mail address to receive the response generated in connection with the request.
10.2.2.- The reason for your request.
10.2.3.- The arguments supporting your request or petition.
10.2.4.- Official document that accredits your identity and proves that you are who you say you are.
10.2.5.- A clear and precise description of the personal data with respect to which it seeks to exercise any of the ARCO rights, and any other element or document that facilitates the location of the personal data.
10.2.6.- In the case of requests for rectification of personal data, the OWNER shall indicate, in addition to the aforementioned, the modifications to be made and provide the documentation supporting his/her request.
10.3 .- LINKSSTER will notify the HOLDER, within a maximum period of 20-twenty days from the date the request for access, rectification, cancellation or opposition, the resolution adopted, so that if it is appropriate, it becomes effective within 15-fifteen days from the date on which the response is communicated. In the case of requests for access to personal data, the delivery shall be made upon proof of the identity of the applicant or legal representative, as appropriate.
11.- Transfer of personal data
LINKSSTER may transfer the personal data of the OWNER to third parties for the following purposes:
11.1.1. To third parties that develop their activities and / or provide their brokerage platform services for sales of backlinks, SEO texts and other SEO services, when they acquire all or a substantial part of the LINKSSTER business, regardless of whether such acquisition is by way of merger, consolidation or purchase of all or a substantial part of its assets. The OWNER will be informed of the sale of all or a substantial part of LINKSSTER to a third party by means of the e-mail he/she has communicated to LINKSSTER or through a prominent announcement posted on the LINKSSTER WEBSITE.
The OWNER expressly consents to the transfer of his/her personal data by LINKSSTER to the third parties mentioned in the previous paragraph.
12.- Modifications
The parties agree that the Privacy Notice may be modified in the time and manner that LINKSSTER determines, taking into account the study and regulations on the protection of personal data arise, so it is obliged to keep it updated, for consultation on the LINKSSTER WEBSITE, in order that where appropriate, the HOLDER is in a position to exercise their rights ARCO.

14.- Applicable law and jurisdiction
14.1.- The parties express that this notice shall be governed by the legal provisions applicable in the Mexican Republic, in particular, by the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals and its Regulations.
14.2.- In the event of a dispute or controversy arising from the interpretation, execution or compliance with the Privacy Notice or any of the documents derived therefrom or related thereto, the parties shall amicably seek to reach an agreement within a period of 30-thirty calendar days from the date on which any dispute arises and the other party is notified in writing of such event, counted from the date on which any difference arises and the other party is notified in writing of such event, deducting the mediation process before the Alternative Justice Center of the Federal District, carried under the Alternative Justice Law of the Superior Court of Justice of Mexico City, formerly the Federal District and its Internal Regulations, in force at the time the dispute arises.
In the event that the parties do not reach an agreement, they hereby agree to submit all disagreements arising from this Privacy Notice or any of the documents derived from it, or that are related to it or to them, to be resolved definitively, submitting to the jurisdiction and laws of the Federal Administrative Authorities or Courts of Mexico City, formerly Federal District, expressly waiving any other jurisdiction that by reason of their present or future domiciles may correspond to them.
